The Supreme Court of Georgia approved UPL Advisory Opinion 2003-2, which treats preparation and facilitation of deeds for others and the closing of Georgia real estate transactions as legal work requiring a Georgia lawyer, subject to limited pro se circumstances. Formal Advisory Opinion 13-1 further explains that the lawyer must exercise professional judgment and control the closing process rather than act as a figurehead.

After authorized disbursement, the closing team follows the approved process for deed and security-instrument recording, title-policy issuance, and final document delivery.

Remote and video-conference closings

Technology does not remove the attorney's responsibility.

State Bar of Georgia Formal Advisory Opinion 23-1 states that an attorney may satisfy applicable closing responsibilities by video conference when the lawyer remains in control of the process from beginning to end. The opinion does not make every transaction eligible for remote closing.

The closing attorney, lender, title underwriter, parties, document requirements, identity-verification process, notarization rules, and recording requirements must all support the selected method. Confirm availability before arranging travel or assuming that a mobile notary can complete the closing independently.
